This year’s Lecture is titled Why Shipping Law Still Matters and will be presented by Sir David Andrew Foxton. This lecture considers how shipping law came to achieve its central role in the formulation of English Commercial Law; why the judicial approach to resolving shipping disputes proved particularly conducive to the formation of business-friendly principles of Commercial Law; and the continued relevance of shipping disputes and Shipping Law today.

Sir David Foxton

David Foxton was called to the Bar by Gray’s Inn in 1989, and practised as a member of Essex Court Chambers for over 30 years, for the last three as Head of Chambers. There, his practice embraced a broad range of commercial disputes, including those arising from shipping and international trade. He was sworn in as a Judge of the Queen’s Bench Division in January 2020, and sits in the Commercial Court. He is the General Editor of “Scrutton on Charterparties” and has published a biography of Lord Justice Scrutton.

Julian Clark

Julian Clark is the firm’s Senior Partner with global responsibility for the firms practice sectors and client base both in London and internationally. He is himself an internationally recognised leader in shipping and international trade with over 30 years’ experience in mediation, arbitration and litigation. Julian has for over 15 years been ranked in the world’s leading legal reference guides including Chambers & Partners 2020 where he is described as being “recommended in the market for his strong relationship with P&I Clubs”, the US publication “Super Lawyers” and Who’s Who Legal who rank him as a “Global Leader”. On leaving his previous position as the Global Head of Shipping of another leading London Firm, the press commented on his recruitment to Ince as being “a major score”. He is also internationally recognised as an expert in piracy, e-commerce (including blockchain), cybercrime, security and terrorism issues in the maritime field. He is the Chair of the Maritime London Innovation and Technical Committee and Cyber Risk subcommittee of the CMI.

Sir Bernard Eder

Bernard Eder is an international arbitrator/mediator based at 24 Lincoln’s Inn Fields, London. He previously practised as a barrister at Essex Court Chambers specialising in commercial litigation and international arbitration. In 2011, he was appointed a Judge of the High Court of England and Wales. He resigned from the Bench in April 2015. During that time, he sat mainly in the Commercial Court in London. In 2015, he was appointed an International Judge at the Singapore International Commercial Court – and re-appointed for a further term in 2018. He was formerly Senior Editor of Scrutton on Charterparties and Chair of ARIAS(UK). Over the years, he has been appointed as arbitrator in over 300 international arbitrations.
